Training Camp License Contract Terms and Conditions

Article 1 General Provisions

  • 1.This training camp license is issued by TDG Holdings Co., Ltd. (hereinafter referred to as “the Company”). ) will plan, recruit, and carry out the event.
  • 2.Participants enter into a training camp license agreement with our company (hereinafter referred to as “this Agreement”). ) will be concluded.
  • 3.The contents and conditions of this contract shall be based on the recruitment advertisement, our website, application screen, reservation confirmation, training camp license contract terms, contract documents, finalization documents, and our standard travel agency terms and conditions (part of the recruitment-type planned travel contract).
  • 4.Unless otherwise specified, “training fees” in these contract terms and conditions refer to the “travel fee” as defined in the standard travel agency terms and conditions, including training fees, accommodation fees, meal costs, and other service fees explicitly stated by our company.
  • 5.Unless otherwise specified, the minimum number of participants for the plan is 1 person. Also, no tour conductor will accompany you on any plan.

Article 2: Application and Conclusion of This Agreement

  • 1.Customers select the driving school, enrollment date, type of driver’s license, and other conditions from the training camp license plan set in advance by our company, and apply for this contract using the method prescribed by our company.
  • 2.Our company will decide whether to accept this contract after reviewing the Road Traffic Act, the admission requirements for the driving school, availability, and other necessary matters.
  • 3.If the applicant is a minor, we will confirm the consent of the legal guardian.
  • 4.This contract is concluded when our company accepts the conclusion of this agreement and accepts the full amount of the application fee or training fee within the period specified by our company.
  • 5.The application fee will be treated as part of the training fee and cancellation fee.
  • 6.If you request to cancel before this contract is finalized, no cancellation fee will be charged. However, if there are already incurred actual expenses, you may be required to bear them within the scope specified in advance.

Article 3 Application Conditions

  • 1.To participate in the training camp, customers must meet the age, qualifications, driver’s license requirements, driving school admission requirements, and other participation requirements specified in advance by our company.
  • 2.In principle, you cannot interrupt the training camp or temporarily return home after enrollment due to your own circumstances. However, this does not apply if the driving school has permission and the school allows re-enrollment, and you have agreed to additional costs, re-enrollment conditions, transportation costs, or other conditions.
  • 3.For plans that assume temporary homecoming plans, please refer to the displayed conditions of the respective plan.
  • 4.Customers with chronic illnesses, physical or mental disabilities, allergies, pregnancy, or other special considerations requiring pregnancy may be requested to notify us at the time of application for this agreement. We will respond to this to the extent possible and reasonable.
  • 5.If we take special measures for you based on the request in the preceding paragraph, the costs incurred for such measures may be borne by the customer.
  • 6.If some customers change or cancel this contract after applying with multiple people, the terms and conditions of other customers or the lesson fees may change due to accommodation rooms, discount conditions, or other circumstances. In such cases, we will explain the changes and whether there are any additional costs.

Article 4: Refusal to Conclude the Contract and Termination of This Agreement

  • 1.Our company may refuse to enter into this agreement if you fall under any of the following categories. If this contract is discovered after its conclusion, the contract may be terminated before enrollment.
    • (1) When the participation conditions clearly stated by our company, the driving school admission requirements, or the requirements under the Road Traffic Act are not met.
    • (2) When the disqualification period has not been completed due to license revocation, driving without a license, or other administrative penalties.
    • (3) When safe driving consultations, medical examinations, or other procedures deemed necessary by our company or driving schools are not carried out
  • 2.If the customer falls under any of the following items, our company may decline your application or, even after this contract is established, terminate this contract in accordance with the standard travel agency terms and conditions and laws.
    • (1) When our company determines that the training may cause inconvenience to other customers or hinder the safe and smooth conduct of the training camp
    • (2) When recognized as an organized crime group member, quasi-member of an organized crime group, related to organized crime groups, or other antisocial forces
    • (3) When the company makes violent demands, unreasonable demands, threatening behavior, violence, damage to credit, obstruction of business, or acts equivalent thereto

Article 5: Cancellation and Changes by Customers Before Enrollment

  • 1. You may terminate this agreement at any time by paying the following cancellation fees. Please note that termination or modification of this agreement will only be accepted during our business hours.

  • 2.Notwithstanding the preceding paragraph, if we specify a lower cancellation fee for each plan, that cancellation fee will be applied.
  • 3.If you wish to amend this agreement, we will accommodate it to the extent possible. However, if the change causes adjustments in training fees, or if actual costs are incurred for driving schools, accommodations, transportation, etc., you may be responsible for the difference or actual costs. If changes cannot be made, you may be asked to cancel this contract and reapply.
  • 4.Cancellations or changes are accepted only during our business hours. Requests made outside business hours will be treated as if they were received on the next business day.

Article 6 Refunds

  • 1.If a refund occurs due to cancellation before enrollment, our company will, in principle, refund the remaining amount after deducting the prescribed cancellation fee from the tutoring fee within 7 days from the day after cancellation.
  • 2.Any refund fees arising from cancellation or changes due to customer convenience will be borne by the customer. However, if the cancellation is due to reasons attributable to us or if it is not appropriate to bear the customer’s burden, it will be our responsibility.

Article 7: Cases Where Cancellation Can Be Canceled Without Paying Cancellation Fees

Customers may terminate this contract without paying a cancellation fee before enrollment if any of the following apply.

  • (1) When the contract details are changed by our company, and such changes involve enrollment dates, expected graduation dates, accommodation facilities, or other significant changes
  • (2) When our company increases the tutoring fee
  • (3) When the safe and smooth conduct of training camps becomes impossible or is extremely likely due to natural disasters, war, riots, terrorism, suspension of transportation or accommodation services, orders from government agencies, or other reasons.

Article 8: Termination and Settlement After Enrollment

  • 1.If you cancel part or all of this contract after enrollment due to reasons attributable to the customer, such as illness, injury, tardiness, absence, or other reasons attributable to the customer, a refund will be made based on the calculation method prescribed by the driving school, deducting cancellation fees, admission fees, material fees, actual expenses such as completed lessons and certification fees, and other expenses.
  • 2.If the Company reasonably determines that the customer is unable to continue the training camp due to illness, injury, or other reasons, the Company may partially terminate this contract.
  • 3.If you terminate this contract after enrollment as described above, except in cases attributable to our company, the costs required for returning home shall be borne by the customer.
  • 4.In the case of cancellation or changes after enrollment, the refund amount and refund method will be handled in accordance with the driving school regulations and other conditions clearly stated by our company.

Article 9: Scheduled Graduation Date, Schedule Changes, and Guarantees

  • 1.The expected graduation date we provide to customers is the date when the lessons, certifications, and exams set by the driving school proceed as planned and the customer successfully completes the required courses. A graduation date does not guarantee obtaining or graduating a driver’s license.
  • 2.If the expected graduation date is postponed due to reasons attributable to the customer, such as failing the written exam or skill test, being late, leaving early, absenteeism, poor health, temporary homecoming, or other reasons attributable to the customer, the warranty will not apply. Any actual expenses incurred in this case—extended night, lesson fees, certification fees, transportation costs, and other expenses—are the responsibility of the customer, except within the scope of guarantees separately stated by the driving school or our company.
  • 3.If a schedule change is required due to natural disasters, war, riots, terrorism, government orders, suspension of transportation or accommodation services, or other reasons beyond our control, we will handle the rescheduling in accordance with the standard travel agency terms and conditions.

Article 10: Provisional License Failure and Temporary Return Home

  • 1.If the driving school manager determines that you have not completed the training course under the Road Traffic Act, or if you are unlikely to pass the completion certification or graduate, or if you fail the provisional license written exam three times, you may be asked to suspend the training camp and temporarily return home according to the school’s regulations.
  • 2.In the case described above, transportation costs for temporary return home, transportation costs upon re-enrollment, lesson fees at the time of re-enrollment or the difference in lesson fees, extended stay fees, and other additional costs shall be borne by the customer. However, if our company or driving school has separately stated warranty terms, we will handle them within that scope.
  • 3.Re-enrollment after temporary return home will be handled after you have re-examined the provisional license written exam, availability of driving schools, re-enrollment conditions, additional fees, and other conditions, and only after obtaining your approval.

Article 11: Changes to Accommodation and Guest Rooms

  • 1.Accommodation facilities to be stayed during the training camp period must be specified in the contract or final documents. However, if our company does not guarantee the facility name, we will designate from among the facilities to be used or equivalent facilities listed in the contract or confirmation documents.
  • 2.Before or after enrollment, accommodation or guest rooms may be changed due to unavoidable circumstances. In such cases, we will strive to provide facilities or rooms as much as possible that match the original conditions.
  • 3.An equivalent facility or guest room refers to a facility where there is no significant difference in the usage of the lodging room, the size per person, the amenities, dining conditions, or other key conditions. However, we do not guarantee that the distance from the driving school, surrounding environment, building age, or renovation timing will be completely identical.
  • 4.If you are using a room alone or with multiple guests, the period you may use the room is limited to the date of graduation specified in the contract or finalized document. If you wish to continue training beyond your expected graduation date, in principle, you will need to share a room or stay under the designated conditions of the driving school.

Article 12: Items Included and Not Included in the Training Fee

  • 1.The training fee includes the training fee up to the expected graduation date, accommodation, meal expenses, and other services explicitly stated by our company or the driving school.
  • 2.The training fee does not include the provisional license exam fee, provisional license issuance fee, additional lesson fees, retest fees, extended stay fees, temporary homecoming expenses, personal expenses during free time, or transportation costs. However, if our company or driving school has separately stated warranty terms, we will handle them within that scope.
  • 3.The specific details mentioned in the previous section vary depending on the driving school and plan.

Article 13 Special Compensation

  • 1.Regardless of whether our responsibility arises, our company will pay compensation and consolation money for certain damages suffered by customers during participation in recruitment-type planned tours, based on the “Special Compensation Regulations” attached to the standard travel agency contract for recruitment-type planned tours.
  • 2.The main coverage details are as follows: However, specific payment terms, payment amounts, exemptions, and accidents or items that are excluded are governed by the “Special Compensation Regulations” attached to the Standard Travel Agency Terms and Conditions.

    Death compensation: 15 million yen
    Disability compensation: amount based on the special compensation regulations for standard travel agency terms and conditions.
    Hospitalization condolence payment: 20,000 to 200,000 yen depending on length of hospitalization
    Consolation allowance for hospital visits: 10,000 to 50,000 yen depending on the number of days of treatment
    Compensation for carry-on items damage: Up to 150,000 yen per person. However, the limit is 100,000 yen per unit or pair, and the deductible is 3,000 yen.

Article 14: Business Security Deposit or Repayment Business Security Deposit

Our company is not a guaranteed member of the Travel Agents Association. Customers can receive repayment from the business deposit deposited by our company in accordance with Article 7, Paragraph 1 of the Travel Agency Act for claims arising from transactions related to the training camp license.
